1. Introduction
These Terms & Conditions ("Terms") govern your access to and use of the VoyageTrail service ("Service"), operated from the United Kingdom. The Service is accessible at app.voyagetrail.app and related subdomains.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
Please also review our Privacy Policy, which explains how we collect, use, and protect your personal data.
2. Service Description
VoyageTrail is a travel tracking application that allows users to log and visualise cruise voyages and flights on an interactive map. Features include:
- Recording cruise voyages with itineraries, ports, and dates.
- Recording flight journeys with airports, airlines, and dates.
- Interactive map visualisation of travel history.
- Travel statistics and analytics.
- AIS-based ship route building using satellite positioning data.
- Itinerary auto-fill from publicly available cruise schedules.
- Data export in JSON and CSV formats.
Feature availability depends on your subscription tier, as described in Section 6.
3. Eligibility
You must be at least 16 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.
During beta or invite-only registration periods, additional requirements (such as a valid invite code) may apply.
4. Account Registration and Security
4.1 Account Creation
To use the Service, you must create an account by providing a valid email address, a display name, and a password. You agree to:
- Provide accurate and complete registration information.
- Keep your login credentials confidential.
- Notify us immediately if you suspect unauthorised access to your account.
- Not create accounts for anyone other than yourself without their express permission.
4.2 Account Responsibility
You are solely responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorised use of your account where you have failed to safeguard your credentials.
4.3 Email Verification
We may require you to verify your email address. Failure to verify your email may result in limited access to certain features of the Service.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorised access to other users' accounts, our servers, or any systems connected to the Service.
- Use automated tools, bots, scrapers, or other means to access the Service in a manner not expressly authorised by us.
- Upload, transmit, or store any content that is malicious, harmful, defamatory, or otherwise objectionable.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Share, resell, or redistribute access to the Service or your account credentials.
- Use the Service to collect or harvest personal data of other users.
We reserve the right to suspend or terminate accounts that violate these acceptable use rules.
6. Subscription Plans and Billing
6.1 Plans
The Service offers the following subscription tiers:
- Free — limited features and usage allowances at no cost.
- Pro — expanded features and higher usage allowances for a monthly or annual subscription fee.
- Voyager — the highest tier with maximum usage allowances (pricing and availability subject to change).
Current pricing is displayed on the pricing page. We reserve the right to change pricing at any time. If pricing changes affect your active subscription, we will notify you at least 30 days in advance.
6.2 Payment Processing
All payments are processed securely by Stripe. By subscribing to a paid plan, you agree to Stripe's terms of service. We do not store your credit card or bank details on our servers.
6.3 Free Trial
We may offer a free trial period for paid plans. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial expires. You will be charged the applicable subscription fee upon trial expiry.
6.4 Auto-Renewal
Paid subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled. The renewal charge will be at the then-current subscription rate.
6.5 No Refunds
All subscription payments are non-refundable. This includes monthly fees, annual fees, and any charges incurred after a free trial converts to a paid subscription.
If you cancel your subscription, you will retain access to paid features until the end of your current billing period. No partial or prorated refunds will be issued for unused time within a billing period.
We strongly encourage you to make use of any available free trial to evaluate the Service before committing to a paid subscription.
6.6 Cancellation
You may cancel your subscription at any time through the billing portal accessible from your account settings. Upon cancellation:
- You will continue to have access to paid features until the end of your current billing period.
- Your account will revert to the Free plan at the end of the billing period.
- Your data will be retained. If you exceed Free plan limits, you will not be able to add new records but existing data will remain accessible.
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its design, code, graphics, user interface, features, and documentation, is the intellectual property of VoyageTrail or its licensors and is protected by copyright, trademark, and other intellectual property laws. The underlying codebase is licensed under the GNU General Public License v3 (GPL-3.0), and nothing in these Terms restricts the rights granted under that licence where applicable.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.
7.2 Your Data
You retain full ownership of all travel data, records, and content you submit to the Service ("Your Data"). We do not claim any ownership rights over Your Data.
By submitting Your Data, you grant us a limited licence to store, process, and display it solely for the purpose of providing the Service to you.
8. Data Accuracy Disclaimer
The Service incorporates data from third-party sources, including:
- AIS (Automatic Identification System) satellite data — ship positions, routes, and port detection derived from AIS transponder signals.
- Cruise itinerary data — schedule and port information sourced from publicly available cruise timetables.
- Airport and port databases — geographic coordinates and identifiers for airports and cruise ports.
We do not guarantee the accuracy, completeness, or timeliness of any third-party data. AIS data may contain gaps, inaccuracies, or delays. Cruise itineraries may change without notice. Port and airport data may be incomplete or outdated.
The Service is intended for personal travel logging and reminiscence purposes only. You should not rely on data provided by the Service for navigation, travel planning, safety decisions, or any purpose requiring verified accuracy.
9. Service Availability
9.1 No Guarantee of Uptime
We endeavour to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled or emergency maintenance.
- Server or infrastructure outages.
- Third-party service disruptions.
- Circumstances beyond our reasonable control.
9.2 Beta Features
Certain features may be designated as "beta" or "experimental". Beta features are provided on an "as-is" basis without any warranty. We may modify, discontinue, or remove beta features at any time without prior notice.
9.3 Service Modifications
We reserve the right to modify, update, or discontinue any part of the Service at any time. Where a material change adversely affects your use of the Service, we will provide reasonable notice.
10. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.
- Our total aggregate liability to you for all claims arising out of or related to the Service shall not exceed the total amount you have paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty pounds sterling (GBP 50), whichever is greater.
Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless VoyageTrail and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service.
- Your breach of these Terms.
- Your violation of any applicable law or regulation.
- Any content or data you submit to or through the Service.
12. Termination
12.1 Termination by You
You may terminate your account at any time by deleting your account from your account settings or by contacting us at hello@voyagetrail.app. Upon deletion, your data will be permanently removed in accordance with our Privacy Policy.
12.2 Termination by Us
We reserve the right to suspend or terminate your account, with or without notice, if:
- You breach these Terms or any applicable law.
- Your use of the Service poses a security risk or may adversely affect other users.
- Your account has been inactive for an extended period.
- We are required to do so by law.
- We discontinue the Service entirely.
Where reasonably possible, we will provide advance notice before terminating your account and give you an opportunity to export your data.
12.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. The following provisions survive termination: Sections 7 (Intellectual Property), 8 (Data Accuracy Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), 14 (Governing Law), and 15 (Dispute Resolution).
13. Third-Party Services
The Service integrates with third-party services including payment processors, email delivery providers, maritime data providers, and content delivery networks. Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices, content, or availability of third-party services.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of your country of residence.
15. Dispute Resolution
Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at hello@voyagetrail.app. We will endeavour to resolve the matter within 30 days.
16. Changes to These Terms
We reserve the right to update or modify these Terms at any time. If we make material changes, we will:
- Notify you by email (using the address associated with your account) at least 14 days before the changes take effect.
- Update the "Effective date" at the top of this page.
Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and VoyageTrail regarding your use of the Service. They supersede all prior agreements, understandings, or arrangements between you and us, whether written or oral.
19. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of VoyageTrail.
